The Residential Tenancies
Tribunal is an independent judicial body and was
created to resolve disputes that arise from time to time between Property
Owners and tenants where those disputes cannot be solved at a personal level.
The Tribunal has the power to
make a decision (called an 'Order of the Tribunal') regarding an application
made to it concerning a dispute, that is legally binding and that decision must
be observed by the party or parties to whom it applies.
Whilst the Tribunal attempts to
be impartial in its judgements, it must be pointed out that the burden of proof
lays with the person who is making an application to the Tribunal for an
order. In other words, the party who is
requesting an order to be made against another party must prove beyond
reasonable doubt that their application is valid.
The majority of actions brought
before the Tribunal are by Property Investors who are claiming compensation
from their tenants and the burden of proof in these instances lays with the
Owner.

that Owners are thoroughly versed in Tenancies Tribunal procedure and are
comprehensively prepared to support their application with hard evidence such
as documentation or photographs and witnesses.
